In the Canary Islands, a court upheld the 8-year prison sentence for a man for the sexual assault of a minor girl with a disability.
In the Canary Islands, a court upheld the sentence of a man to 8 years in prison for sexual assault against a girl who was not yet 16 years old and had a disability (51%).
The court rejected the defense's appeal, upholding the previous decision of the court in Santa Cruz de Tenerife. There, the man was found guilty of taking advantage of the girl's state of intoxication and helplessness to commit the crime. Attorney José Manuel Niederleytner represented the victim's interests.
It all happened on December 5, 2022. The man invited the girl to his home in the city of Frontera. They had known each other for about four years, and the girl trusted him. Initially, she came with a friend, but then the friend left, and they were alone.
The man treated the girl to alcoholic cocktails. Then he started talking about sexual topics, knowing about her disability and the fact that she was drunk, confused, slurring her speech, and barely able to stand.
He offered her a dance and tried to kiss her, but she pushed him away. Then he sat her on his lap in a chair and began to kiss her.
Then he took her to the bedroom, undressed her, and touched her. After that, he dragged her to the bathroom, put her in the tub, smeared her with oil, and raped her. At night, he drove the girl not far from her house. There, a woman and her daughter helped her and took her to the hospital because the girl was in a state of severe stress. Due to the experiences, she now has psychological problems.
The court rejected the criminal's appeal, considering that the previous court correctly assessed the evidence, including the victim's testimony, which was "consistent, clear, and without contradictions," as well as the findings of doctors and genetic evidence.
