The case centers on the officer’s search for two license plates that, according to the prosecution, belonged to unmarked police vehicles. Prosecutors argue that when the officer searched these plates, the system displayed an error message indicating the vehicles were official—a warning they claim most officers should recognize. However, other officers testifying in court stated they were unaware of this specific system feature, complicating the question of whether the defendant acted with criminal intent.
The defense, led by attorney Abraham Hernández, argues that no crime occurred because the system did not actually provide any sensitive information. The officer, who chose not to testify, claims he only checked the plates because his father-in-law was concerned about suspected thefts at his garage. Coincidentally, the vehicles in question were being monitored as part of an unrelated weapons trafficking investigation involving an associate of the father-in-law, rather than the officer’s family.
The prosecution has since introduced a mitigating factor: once the misunderstanding was cleared up, both the officer and his father-in-law cooperated with investigators, ultimately helping the weapons trafficking operation succeed.
Despite this cooperation, the case highlights the strict standards of confidentiality expected of law enforcement. While the defense has requested an acquittal, the trial underscores the fine line between using police tools for legitimate work and the potential misuse of sensitive information.
