Tenerife Men Investigated for Assault Following Citizen’s Arrest of Minor

Two men are under investigation for assault in Tenerife after using excessive force while detaining a teenager they accused of theft.

A debate over public safety and the limits of citizen intervention has emerged in San Miguel de Abona, Tenerife, after two men were investigated for assault following an incident involving a minor.

The event occurred last Monday in the Guargacho neighborhood. According to local reports, two adults intercepted an Italian teenager after he allegedly stole a cash register from a local business.

The incident, which was captured on video and shared online, raises questions about the legal boundaries of a "citizen’s arrest." Under Article 490 of Spain’s Criminal Procedure Act, any person is legally permitted to detain someone caught in the act of committing a crime. However, Spanish law strictly prohibits the use of excessive force, physical retaliation, or vigilantism.

In the footage, the two men are seen holding the minor down, punching and kicking him, and making verbal threats while waiting for the Civil Guard to arrive.

Once officers reached the scene, they took the teenager to the Granadilla de Abona station. The case has since been referred to the Juvenile Prosecutor’s Office in Santa Cruz de Tenerife, which will determine the minor's liability for the alleged theft. Simultaneously, authorities are investigating whether the two men’s actions went beyond a lawful citizen’s arrest and constituted assault or coercion.

Following police processing, the teenager was released into his mother's custody. The case highlights the fine line between public cooperation in safety and the risk of escalating violence, which can lead to further legal consequences for those involved.
