Tenerife Man Released Amid Conflicting Testimony in Sexual Assault Case

A Tenerife man arrested for alleged sexual assault and illegal detention has been released without restrictions after a judge and prosecutors found insufficient evidence to justify precautionary measures amid conflicting witness accounts.

A man arrested in Tenerife last Sunday on charges of sexual assault, threats, and illegal detention has been released, sparking a debate over the legal criteria used during investigations. The judge at the Court of Violence Against Women in La Orotava ordered his release without any restrictions, a decision supported by the Public Prosecutor’s Office, which found no sufficient evidence to justify imprisonment or other precautionary measures.

The case, which occurred at a property on Calle Real in Icod El Alto, Los Realejos, has become procedurally complex due to conflicting accounts. The two complainants, who were renting the property from the accused, provided statements that reportedly contained significant contradictions. Furthermore, a third party provided a version of events that differs substantially from the women’s claims, prompting the court to order further investigation to clarify what happened.

Police were called to the property by the complainants, and the owner cooperated with officers before being taken into custody.

From a legal standpoint, this case highlights the challenges courts face when initial evidence is not strong enough to justify depriving someone of their liberty. Under Spanish law, precautionary measures—such as jail time or travel restrictions—can only be imposed if there is a clear risk of the suspect fleeing, reoffending, or destroying evidence. In this instance, the judge opted for caution, prioritizing the presumption of innocence while the investigation continues.
