Tenerife Court Weighs Conflicting Testimony in Complex Sexual Assault Trial

A trial currently underway at the Provincial Court of Santa Cruz de Tenerife highlights the legal challenges of sexual assault cases that rely solely on conflicting testimonies without conclusive forensic evidence. The court is reviewing a rape complaint from February 2020, involving an incident that allegedly occurred in Arona on the eve of Three Kings' Day that year.

The case is legally complex because the Public Prosecutor’s Office has requested that the charges be dismissed, citing insufficient evidence. In contrast, the private prosecution is seeking an eight-year-and-six-month prison sentence for the accused. The situation is further complicated by the fact that the two individuals had been close friends since childhood and lived in the same residential complex.

According to reports, the complainant alleges that after spending the afternoon drinking and using cannabis with friends, the accused assaulted her when they were alone. The complainant, who was a minor at the time, did not tell her family about the incident until 40 days later. This disclosure followed a confrontation with the parents of the accused, who had visited her home to complain that their son was being defamed and had been physically attacked by others due to the rumors.

Psychological evaluations have added to the uncertainty. While experts confirmed the young woman suffers from an affective disorder and has a history of self-harm, they could not link these issues directly to the alleged assault, noting that she had a prior history of depression following the death of a parent.

This case underscores the difficulty Spanish courts face when handling sexual assault allegations. Without eyewitnesses or immediate forensic evidence, judges must carefully weigh conflicting accounts. The defense maintains the accused is innocent and has requested an acquittal in a case that has not only reached the courtroom but has also deeply divided a local community.
