Spanish Court Releases Polish Fugitive Facing 485-Year Sentence, Sparking Police Outcry
The Spanish National Court’s decision to release Lukasz Feliksiak, a Polish fugitive facing 49 serious criminal charges, has sparked frustration among investigators who view him as a significant flight risk.
The provisional release of Lukasz Feliksiak, a Polish citizen wanted under a European Arrest Warrant, has sparked confusion among Spanish police and Polish judicial authorities. Despite facing 49 charges in Poland—including violent crimes, drug trafficking, fraud, and illegal weapons possession—which could carry a 485-year prison sentence, the Spanish National Court has ordered his release.
The decision, made by Central Investigating Court Number 6, followed a recommendation from the Public Prosecutor’s Office. The court determined that the risk of Feliksiak fleeing was low and viewed the severity of his alleged crimes differently than Polish authorities.
This ruling is particularly surprising given Feliksiak’s history of evading capture. After a seven-month investigation, Spanish National Police finally arrested him in Arona, Tenerife, last April. His criminal record includes several past escapes, such as jumping from a balcony to avoid police and fleeing a routine traffic stop in February, during which he used fake documents and endangered both officers and other drivers.
The operation to arrest him in Arona required the elite Special Operations Group (GOES) to ensure he could not resist. Now, however, investigators feel their hard work has been undermined. While the court has ordered Feliksiak to surrender his passport, remain in Spain, and report to the court every two weeks, the disagreement over his flight risk has ignited a debate about how courts assess a defendant's background.
The European Arrest Warrant is intended to simplify the extradition of criminals between EU member states by removing political bureaucracy. However, this case highlights the tension that can occur when a host country must balance a suspect's local ties against the gravity of the charges they face in their home country. As the legal process continues, Feliksiak’s defense team supports the court’s decision, leaving investigators frustrated after months of tracking a suspect known for his extreme efforts to remain hidden.
