The Guimar City Council has removed the powers and positions of councilors Patricia Encinoso Pestano and Jose Miguel Hernandez Fernandez due to a vote of no confidence in the mayor, redistributing their duties and statuses.

The municipality of Güímar officially confirmed yesterday the removal of powers and positions of the councilors, currently socialists, Patricia Encinoso Pestano and José Miguel Hernández Fernández, after the motivated motion of no confidence that both signed against the current mayor, Gustavo Pérez (CC). This is confirmed by two decrees published in the Official Gazette of the Province (BOP).

In one of the announcements, Encinoso, who until now held the areas of Festivities, OMIC (Municipal Consumer Information Office), and Transportation, was relieved of her duties and the regime of exclusive dedication. The revocation annuls the mayoral decree that appointed her as responsible for these areas.

In the case of José Miguel Hernández, the measure resulted in the loss of his position as fourth deputy mayor, as well as his powers in Heritage and Municipal Services, Economy and Finance, Tax Management, General Administration, Internal Regime, and Personnel. His exclusive dedication, which he had since his appointment, has also been revoked.

The decree provides for the redistribution of the powers that Encinoso and Hernández managed. The revoked areas are temporarily delegated to councilors Airam Puerta Pérez and Cándido Gómez Gómez, pending a broader restructuring in the municipal structure.

Both decrees are added to the previously announced news of their party after confirming that both councilors, at that time part of the government coalition bloc together with CC and Unidos sí podemos, supported the motivated motion of no confidence.

The secretary of the island organization of the PSOE, Óscar Olave, stated that both councilors will acquire the status of non-attached councilors, as stipulated by Law 7/2015 on Municipalities of the Canary Islands.

This change of status entails limitations, such as that they can no longer receive remuneration for exclusive or partial dedication or assume areas or positions of government that involve economic compensation.

"The legal system clearly establishes that no non-attached councilor can be part of the government with a salary, or hold positions of leadership," Olave stated, emphasizing that, in this regard, the legislation is designed to avoid episodes of political transfuguism, which, in his opinion, have occurred in Güímar.
