Tenerife: Friend stated that the minor had asked to conceal her age from the accused rapist

At a trial in Spain, on the island of Tenerife, a friend of a minor girl who was allegedly sexually assaulted during the carnival, testified that the girl had asked her not to tell the accused that she was underage.

The witness claims that they both drank a lot of alcohol. Soon after meeting the man, the girl left with him, and then called her friend and told her what had happened.

Prosecutors are seeking a 15-year prison sentence and a fine of 15,000 euros for the accused. The lawyers insist on a full acquittal, arguing that his guilt has not been proven.

The accused said that he came to Tenerife from Ibiza to meet friends. There he met the girl and her friends, who did not say a word about their young age. According to him, the victim assured him that she was 17 years old.

He offered her intimacy "because he wanted it" and they went to a street toilet near the Plaza de España. He insisted that she go in there with him, but assures that he did not force her.

Suddenly someone knocked on the door. They saw a man in a costume who introduced himself as a police officer and began questioning them. They denied being a couple.

Doctors who examined the girl on the night of February 13 said that she was "incoherent", her words were confused, and she had signs of intoxication, but not too strong. She "vaguely remembered being in the restroom, and that's all."

When asked by the prosecutor whether the girl looked older than her age, the experts replied that her appearance corresponded to 15 years. The examination did not reveal any signs of violence during sexual intercourse.

The analysis showed that the girl's blood alcohol level was 1.31 per mille, although it could have been higher, as the sample was contaminated. The psychologist confirmed that the incident did not cause any mental trauma.
