Arona Council Reissues Stop Work Order for Over-Excavated Plot
Arona City Council has again halted work and suspended a building permit for an agricultural plot in Parque La Reina, citing land leveling that significantly exceeded planning rules, despite a previous court ruling against the council.
Arona City Council has once again ordered a stop to work and suspended a building permit for an agricultural plot in Parque La Reina. This shows the council is determined to enforce its building rules, even after losing a court case about it before. They took this action because they found that the land leveling and farming preparation work went beyond what the planning rules allow.
DIARIO DE AVISOS, a local newspaper, had already reported on this. They covered complaints from neighbors about damage to nearby homes. The paper noted that there was already an official planning investigation showing the work had gone too far. Now, the City Council has taken formal action.
According to council records, the work done far exceeds what was allowed. The permit, issued in 2018, was for leveling land and preparing it for farming, with a maximum height limit of three meters. But the digging and earth moving reached nearly ten meters – three times the allowed height.
This isn't the first time this has happened. The City Council had previously ordered the plot to be shut down, but the company appealed. A court then ruled in favor of the company. The court found that the way council technicians measured the work was flawed because they used a crane as a reference point, which the judge said made their calculations unreliable.
However, the City Council now says that after new technical checks, the work still goes beyond what's allowed. This is why they are ordering the closure again. At the same time, the council is looking into whether to make the company restore the land to its original state and who is responsible for what happened.
